NEW FORM I-9

EFFECTIVE FEBRUARY 2, 2009

The United States Citizen and Immigrations Service (USCIS) has issued a new Form

I-9 (Employment Eligibility Verification), which is required to be completed by new employees and their employers - starting February 2, 2009. The form is verification that the new hire is a United States citizen or legally able to be employed in the United States.

The Form is not filed with any governmental agency - it is kept "on file" with the employee's personnel file, at the employer's business. Various US governmental agencies have the right to review the form. Failure to have the correct and completed form may subject the employer to fines.

Changes to the form include :

  • Specifying that expired documents are no longer acceptable.
  • Eliminating "Temporary Resident Card", and older versions of the "Employment Authorization Card/Document" from list of acceptable documents that establish Identity and Employment Authorization.
  • Adding machine readable foreign passports of Micronesia and Marshall Islands to list of acceptable documents that establish Identity and Employment Authorization.
  • Adding new US passport to list of acceptable documents that establish Identity and Employment Authorization.
  • Revising employee attestation section of form.
